What does occasional lease mean?

Occasional lease is an increasingly common form of lease agreement, as it transparently defines the rules between the Tenant and the Landlord. It should be remembered that an occasional lease agreement must be in writing, is concluded for a fixed term, no longer than 10 years, and requires mandatory attachments:

  • the Tenant’s designation of another premises in which he will be able to live in the event of eviction;
  • the consent of the owner of the indicated premises for the Tenant to occupy in the event of eviction;
  • the Tenant’s declaration in the form of a notarial deed (Article 777 of the Code of Civil Procedure), in which he undertakes to vacate and hand over the rented property.

Names and surnames of the parties to the lease, date of conclusion and termination of the lease agreement, address of the rented property, courier delivery details or parcel locker address and invoice details

The price of the declaration for the occasional lease agreement is PLN 399 gross payable online or upon receipt of the courier shipment. After placing the order, you will receive an email from us confirming receipt of the data.

Order placed - what happens next?

In the case of a PDF declaration with a qualified electronic signature, you will receive an email from us containing:

  • PDF declaration signed by the Company’s representative expressing consent for the Tenant to reside in the premises belonging to the Company,
  • PDF Declaration for the Tenant, in which the address for eviction is indicated as the premises belonging to the Company,

In the case of a declaration with a notarized signature, you will receive a parcel from us to a parcel locker or a courier shipment within 2 business days containing:

  • A declaration signed by the Company’s representative expressing consent for the Tenant to reside in the premises belonging to the Company,
  • A declaration for the Tenant indicating the premises belonging to the Company as the address for eviction,

After completing the documents, you should go to a notary, where you will voluntarily submit to the rigors of Article 777 of the Code of Civil Procedure. Then all that is left is to hand over the documents to the Owner, collect the keys and move into the rented premises.

FAQ

The price for ordering a declaration for an occasional lease agreement is PLN 399 gross, payable online or upon delivery by courier.

The amount of PLN 399 is a one-off, fixed amount regardless of the duration of the occasional lease agreement or the number of people signing the agreement.

The declaration can be ordered by the Owner of the apartment, the Tenant or the Real Estate Agent on behalf of their client.

You will receive a paper declaration with a notarized signature within 2 business days of placing your order.

Documents in PDF format with a qualified electronic signature are sent on the day the order is placed (for orders placed by 5:00 p.m. on business days).

To order a statement, select the “ORDER A STATEMENT” button, then create an account and fill out a short form. You will need the following information: first and last names of the parties to the agreement, duration of the agreement and the address of the rented property.

We do not require you to send any documents or scans thereof.

We issue a declaration of consent to reside in our premises for the duration of the contract for which the documents were ordered.

From a legal point of view, both forms are equally important. It is up to the property owner to decide which form of documents they want to receive

STATEMENT WITH QUALIFIED ELECTRONIC SIGNATURE:

  • A qualified electronic signature has the same legal force as a handwritten signature. It is certified by a special qualified certificate. Only the person to whom the signature and certificate are assigned may use it. Thanks to this, you can be sure that the signature on the document is 100% authentic.
  • The signature is submitted by the President of the Management Board of the Company
  • We send attachments in PDF format to your email address. If you place your order by 5:00 PM on a business day, you will receive the documents the same day.
  • The document should be sent to the email address of the notary office where you are going under penalty of execution and to the owner of the rented property.
  • A qualified electronic signature replaces the need for notarial certification. This is a huge convenience for people who value time.

STATEMENT WITH NOTARIAL SIGNATURE:

  • A notarized signature is made in the presence of a notary who confirms the authenticity of the signature. This form allows its credibility to be recognized beyond any doubt.
  • The signature is submitted by the President of the Management Board of the Company, the Proxy of the Company or a Member of the Management Board of the Company.
  • Documents are sent in paper form to a location of your choice (e.g. to a parcel locker, home, office, notary’s office). If you place an order by 1:00 p.m. on a business day, the documents will be sent via InPost the same day.
  • The documents, along with the signed occasional lease agreement, should be taken to the notary’s office where you go under penalty of execution. Then you hand over the complete set of documents to the owner of the rented property.
